Making a privacy complaint

If you feel that your privacy has been infringed by a South Australian Government agency you should, in the first instance, speak directly with the agency that you think has breached your privacy. You can use the list of South Australian Government Departments to find contact details for the relevant agency.

If the agency is unable to help you, or you are dissatisfied with the response, you can lodge a complaint with the Privacy Committee of South Australia.

Complaints to the Privacy Committee of South Australia must be made in writing and can be received by mail, fax or email:

If you need help lodging a complaint, you can call our Privacy information line on 08 8204 8786.

If your complaint relates to a Commonwealth Government agency or private sector organisation you should direct your enquiry to the Office of the Australian Information Commissioner. The Privacy Committee is unable to respond to privacy complaints concerning these organisations.

How your complaint will be handled

In the first instance, the Privacy Committee will forward your complaint to the agency concerned and seek a response as to whether they consider a breach of the Information Privacy Principles has occurred and, if so, what action has been or might be taken to resolve the matter. The Privacy Committee will assess the response and, if necessary, make a recommendation to the agency to amend their practices or to adopt other measures to resolve the complaint. The Committee will acknowledge receipt of your complaint in writing and provide you with updates throughout the complaint resolution process as necessary.

If the complaint relates to privacy breaches in the delivery of Government health services, the Committee may refer the complaint to the Health and Community Services Complaints Commissioner. If the complaint relates to privacy breaches in relation to the South Australian Police, the Committee may refer the complaint to the Police Complaints Authority.

The Committee will also accept complaints in relation to South Australian universities and Local Government. While there is no legislated or administrative privacy regime that applies to these organisations, the Committee has worked with them in the past to resolve complaints and improve their practices when handling personal information.

The information you provide will only be used to help resolve your privacy complaint. Your information will be disclosed to the agency concerned and other relevant parties, only where necessary to resolve your complaint.
